Release of Liability, Waiver of Claims and Indemnity
In consideration of being permitted to attend, enter upon, participate in, or remain at the Event or on the Property, I agree as follows:
1. WAIVER OF CLAIMS
I irrevocably waive, release and abandon any and all claims, demands, actions, causes of action, liabilities, damages, costs, expenses or proceedings of any nature whatsoever, whether in law or equity, whether known or unknown, present or future, that I may have against:
(a) the owner or occupier of the Property;
(b) the host of the Event;
(c) any volunteers, organizers, employees, contractors, agents, invitees or representatives connected with the Event; and
(d) any society, association, club, non-profit organization or other entity associated with or connected to the Event or the homeowner,
(collectively, the "Releasees").
This waiver includes, without limitation, any claims arising from negligence, gross negligence to the fullest extent permitted by law, breach of contract, breach of statutory duty, breach of common law duty, occupiers’ liability, or any duty of care arising under the laws of British Columbia, including the Occupiers Liability Act, RSBC 1996, c. 337, as amended.
2. RELEASE AND DISCHARGE
I release and forever discharge the Releasees from any and all liability for any injury, illness, death, loss, damage, expense or inconvenience suffered by me arising out of or connected in any way with attendance at, participation in, travel to or from, or presence at the Event or on the Property, regardless of cause, including any negligence or alleged negligence of the Releasees.
3. INDEMNITY
I agree to indemnify, defend and hold harmless the Releasees from and against any and all claims, demands, actions, damages, liabilities, losses, costs and expenses, including legal fees on a solicitor and own-client basis, arising from:
(a) my attendance, conduct or participation at the Event or presence on the Property;
(b) any injury, loss or damage caused by me to any person or property; and
(c) any claim brought by my family members, heirs, dependants, insurers or third parties contrary to this Agreement.
4. NO LIABILITY OF SOCIETY OR ASSOCIATION
I expressly acknowledge and agree that any society, club, association or non-profit organization connected directly or indirectly with the Event or the homeowner has no responsibility for the condition, supervision, operation or safety of the Property or Event and shall bear no liability whatsoever for any injury, loss, damage or expense arising from the Event or attendance at the Property.
5. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute arising from this Agreement or the Event shall be brought exclusively in the courts of British Columbia.
6. SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
7. ACKNOWLEDGEMENT
I confirm that I have read and understood this Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement. I understand that by signing this Agreement I am giving up certain legal rights, including the right to sue the Releasees for negligence or for any claim arising under the Occupiers Liability Act or otherwise under the laws of British Columbia.
I sign this Agreement freely and voluntarily and intend it to be binding upon myself, my heirs, next of kin, executors, administrators, personal representatives and assigns.
